Appointment of Attorney General of Bhutan and Dzongda

His Majesty the King, by warrant under his hand and seal, appointed the attorney general and the Chukha dzongda on the recommendation of the Prime Minister.

According to a press release from the royal civil service commission (RCSC), the drangpon of Punakha district court, Rinzin Penjor, was appointed as the attorney general, according to article 2.19 (i) and article 29.2 of the Constitution, and Tshewang Rinzin, senior dungpa of Weringla dungkhag, Mongar as the Chukha dzongda, according to article 2.19 (q) of the Constitution. Tshewang Rinzin also served as the district education officer in Chukha before he served as Weringla dungpa.
The office of the attorney general (OAG) was functioning without an attorney general for more than a year and was publicly criticised for taking up petty issues not worthy of prosecution in court. According to judiciary officials, OAG blatantly misuses its authority by not looking whether it a case is worth prosecuting or not.

“We’ll now focus on high profile cases and not handle every case that the ACC forwards,” said the newly appointed attorney general Rinzin Penjor, who served more than 13 years in the judiciary. “OAG will not take up old cases and will look into cases that came after the enactment of the ACC act,” he told Kuensel.

The role of the attorney general as chief legal officer, as enshrined in the Constitution, shall be to act as the legal advisor to and be legal representative of the government.

The attorney general has the power to institute, initiate, or withdraw any case in accordance with the law and has the right to appear and express opinions on any legal question in parliament. The attorney general will submit an annual report to the Druk Gyalpo and to the Prime Minister.

Rinzin Penjor, who did his LLM from Canada, served in the royal Bhutan army (RBA) as a militia officer for five years before joining the judiciary in 1990. Since then, he has served as drangpon in Tsirang, Trongsa and Sarpang district courts. Source: Kuenselonline
